1. Overview
This website, sibyo.org, is operated by Sibyo ("Sibyo," "we," "us," or "our"), based in Illinois, United States. By visiting our site or purchasing from us, you agree to these Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy and Refund Policy, which are incorporated by reference. If you do not agree, please do not use the site.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you are younger, you may use the site only with the involvement and consent of a parent or guardian.
3. Products and wellness disclaimer
Our products are general wellness, comfort and lifestyle items. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Statements on this site have not been evaluated by the U.S. Food and Drug Administration. Product descriptions are for general information only and are not medical advice.
Always read and follow the instructions, warnings and age guidance that come with each product. Consult a qualified healthcare professional before use if you are pregnant, nursing, have a medical condition, a pacemaker or other implanted device, reduced sensation, or circulation problems. Heated products can cause burns if misused: do not use them while sleeping unless the product is designed for it, and never leave them on unattended skin for long periods. Products should be used by children only under adult supervision. You are responsible for using products safely and as intended.
4. Product information, pricing and availability
We work to display products, colors and specifications accurately, but small variations from photos and descriptions can occur, and screens display colors differently. Prices are listed in U.S. dollars and may change at any time without notice. We may limit quantities, discontinue products, or correct errors in pricing or descriptions at any time, including after an order is placed. If a product was listed at an incorrect price, we will contact you and you may cancel for a full refund.
5. Orders and payment
Your order is an offer to buy. We may accept, decline or cancel any order, for example if a product is unavailable, if we suspect fraud, or if the order appears to be placed by a reseller. If we cancel an order after you have been charged, we will refund the full amount. Payment is processed securely by our checkout provider; we do not store full card numbers. Applicable sales tax is calculated at checkout.
6. Fulfillment, shipping and risk of loss
Orders are fulfilled by our supplier and warehouse partners, some of whom are located outside the United States. Shipping times and rates are described in our Shipping Policy. Title and risk of loss pass to you when the order is delivered to the shipping address you provided.
7. Returns and refunds
Returns, refunds and cancellations are governed by our Refund Policy.
8. Accounts
If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please provide accurate information and keep it up to date.
9. Acceptable use
You agree not to use the site for any unlawful purpose; to interfere with its security or operation; to upload malicious code; to scrape, copy or resell our content or products without permission; or to submit false, abusive or infringing content, reviews or messages.
10. Intellectual property
The Sibyo name, logo, site design, text, graphics and original images are owned by or licensed to Sibyo and are protected by law. You may not copy, reproduce or use them without our written permission. Third-party trademarks mentioned on the site belong to their respective owners.
11. Feedback and submissions
If you send us comments, reviews, ideas or other submissions, you grant us a non-exclusive, royalty-free right to use, edit and publish them in connection with our business. You confirm your submissions are your own and do not violate anyone's rights.
12. Third-party services and links
Our site may link to or rely on third-party services such as payment processors, shipping carriers and tracking tools. We are not responsible for third-party websites, content or practices, and your use of them is at your own risk and subject to their terms.
13. Disclaimer of warranties
To the fullest extent permitted by law, the site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, except any warranty that cannot be excluded under applicable law. We do not guarantee that the site will be uninterrupted, error-free or free of harmful components.
14. Limitation of liability
To the fullest extent permitted by law, Sibyo and its owners, affiliates, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the site or any product. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Sibyo and its owners, affiliates, suppliers and service providers from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the site or products, or your violation of any law or the rights of a third party.
16. Dispute resolution and arbitration
Please read this section carefully. It affects how disputes are resolved.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at sibyo.info@gmail.com with a description of the issue, and to give us 30 days to try to resolve it informally. Most concerns are resolved this way.
Binding individual arbitration. If a dispute is not resolved informally, you and Sibyo agree that it will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be conducted by video, phone or written submissions, and judgment on the award may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small claims court if it qualifies.
No class actions. To the fullest extent permitted by law, disputes will be resolved only on an individual basis, and not as a class, consolidated or representative action. You and Sibyo each waive the right to a jury trial.
Opt out. You may opt out of this arbitration agreement by emailing sibyo.info@gmail.com within 30 days of your first purchase, with your name, order number and a clear statement that you opt out of arbitration.
This section does not prevent either party from seeking relief for intellectual property infringement in court.
17. Governing law
These Terms are governed by the laws of the State of Illinois and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict of law rules. Subject to Section 16, any court proceeding will take place in the state or federal courts located in Illinois.
18. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will change. Orders placed before an update are governed by the Terms in effect when the order was placed.
19. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the policies referenced above are the entire agreement between you and Sibyo regarding the site and your purchases. Our failure to enforce any provision is not a waiver.
